Chalk up another one for those wacky activist judges who refuse to go by the letter of the law and instead mete out their own personal brand of justice based on an ideologly that has nothing to do with any what the law actually says.
Oh, and I'm not getting baited here, sorry.

What does he mean, you don't have the right to provoke someone? People, including you, judge, exercise that right every day.

Have you tried searching the court records that are supposed to be made public?

This was linked on the Yahoo page, and it has video and links to the audio of the hearing.
Looking at the video, I have to agree, the guy is a doofus. But he has a right to be.

The Washington Post recently reported on an appeals court decision to maintain an injunction to stop the implementation of an amendment to the Oklahoma state constitution that bans the use of Sharia law in state courts. The excuse the court gave was that there was no documented case of Sharia law being invoked in an American court. Judge Martin would seem to have provided that example, which should provide fodder for the argument as the case goes through the federal courts.

We've trashed on Je-sus for how long, and Muslims think they deserve special treatment?

Hold your breath... wait for it...
This isn't a religious thing for me right now!
Judges all over the nation at almost every level have been behaving in such a manner regarding nearly every aspect of law and social ideology for thirty years and in growing numbers. It's called judicial activism. Getting your eyes open yet? This is hardly the first time a judge disregarded the letter of the law and instead held up his bullsh!t personal opinion as what should prevail. Think about that as the U.S. Supreme Court starts deciding on something that matters to you. Then, think about which president made the appointment and which Congress made the confirmation.

As a Muslim, I know for a fact that the main reason why other Muslims get angry when Muhammad is depicted in any way is because it is a religious thing. In Islam, it is a no-no to draw or act like Muhammad in any way, and that includes dressing up as a zombie Muhammad deliberately angering a faith for kicks and giggles. Not saying that there should be a nation-wide legalization of abuse against those who insult Muhammad, but have some #### respect, people. The Zombie Pope didn't get attacked because the pope is just a figurehead in the grand scheme of things. If he was dressed like Zombie Jebus now, that's where you'll see Catholic's flip their ####

"Judge Martin stated that the First Amendment of the Constitution does not permit people to provoke other people."
ehh yeah it does, other wise all those white supremacist and other similar groups wouldn't be getting away with what they do.
This article made my head hurt.

I highly doubt you would. Because there've been plenty of things like that before, and nobody got attacked.

And if a catholic physically assaulted the guy dressed as zombie jebus he should be charged with assault, same as the Muslim who physically assaulted this guy.
The first amendment gives us the right to offend people, their is no right that protects people from being offended. People say and do things offensive to me all the time, I don't assault them.
I don't mean to offend either, I have as much respect for Islam as I do for any other religion, and have defended the religion on these boards from people like animecandy, but "he insulted my religion" is a excuse and it should not get you off the hook for assault.

I'm not saying he shouldn't be charged with assault, as he did assault a guy. I'm just pissed how people always turn this argument into an anti-Muslim sentiment where just because Mulsims don't like to see Muhammad being drawn or acted out means Sharia Law all over America and stories like this really fire up the anti-Muslim crowd and keep the wheel turning for more and more discrimination.

yeah I don't see this case as proof that Sharia Law is invadeing america. I don't really think their is any danger of that. I think it's just a case of a judge doing something stupid. It happens all the time, it just happens religion was involved this time so it bacame big news.
But yeah people will be bigioted ####, can't stop that.

If the judge is censured or removed from the bench or whatever, I can't wait to see how Fox will spin that. Would it be a sign that Sharia law is taking over America? Or would it be another shot fired in the War Against Religion™? Or activist judges destroying the Constitution?
With Fox, it could be all three!
